Super fund dispute

Jane* went to Central Queensland Community Legal Centre for advice related to the death of her de-facto husband. She wanted to access her husband’s superannuation fund. They had a child together who was still under 16.

Although Jane had all the necessary documents to support her applicaiton, the super fund disputed this because the client was a de-facto partner and their relationship was marred by domestic violence for 20 years. They said there was no evidence of this relationship.

Central Queensland Communty Legal Centre helped Jane by submitting evidence and the super fund eventually accepted the evidence, paying 50% of the benefit to Jane and the other 50% to her child.
