Volunteers at QPILCH’s Self Representation Service assisted Nadine* who held an enduring power of attorney for her elderly father. Nadine and her brother were both appointed as executors under her father’s will; and her father had lost capacity after making the will.
Nadine’s parents had earlier given her brother money to purchase a home for them; however her brother then sold the property and took the sale proceeds.
Over a series of appointments volunteers from Barry.Nilsson, Ashurst, DLA Piper, Clayton Utz, MurphySchmidt, Allens and K&L Gates gave Nadine some preliminary advice, assisted Nadine to draft her application to the Supreme Court to make a new will on behalf of her father naming Nadine as sole executor.
Volunteers also gave Nadine advice about serving her proceedings and attending the hearing. Nadine was successful in her application and she will now be the sole executor of her father’s will.
