Jenny*, a Torres Strait Island woman, was seriously assaulted by her non-indigenous partner which left her bruised, with injuries and caused her to temporarily lose consciousness.
She called the police as soon as she could, but the police detained her and filed a Domestic Violence Order to protect her partner (who already had a criminal and domestic violence record).
The Aboriginal and Torres Strait Islander Women’s Legal Service NQ was able to contest this Order and file another for Jenny’s own protection, as she feared for her safety and that of her family. This Order was granted and the police withdrew theirs.
