Win for farmers challenging New Acland Coal mine expansion

The Environmental Defender’s Office Qld represented the Oakey Coal Action Alliance– a community group with more than 60 farmers and residents.

The group wanted to put in an objections to the approval of an environmental authority and two mining lease applications for the proposed expansion of the New Acland Coal Mine, west of Toowoomba.

The Queensland Land Court recommended outright rejection of the New Acland Coal mine expansion. The land court found that the predicted impact to the groundwater had major shortcomings and would create risks for the surrounding landholders

The Land Court also said that the land around New Acland was in the best agricultural land in 1.5% of the State; and that due to intergenerational equity the mine should not go ahead.

This decision means that the Queensland Government needs to consider the recommendation of the Land Court by early 2018.
