Alice had to flee her rental property for her and her children’s safety. Her partner had physically attacked her and put her in hospital. While in hospital her partner breached the protection orders and attempted to harm her.
Through the assistance of support agencies, Alice tried to advise the rental agent that she needed to be removed from the tenancy. The agent insisted that she still had to keep paying half the rent of the property, as her name was on the lease agreement. The agent informed her that she had to communicate with her partner to ensure the rent was up to date and all bills paid. Alice was clearly at risk of damage and injury, but she continued to pay half the rent for six months.
Alice approached Suncoast Community Legal Service and they helped her take the matter to QCAT where her name was removed from the tenancy agreement.
