Hava, who was from Myanmar wanted to lodge a protection application. He had a strong fear of returning to his home country, and would be at serious risk of being removed from Australia if he did not lodge an application.
However, due to his severe mental health issues and confusion about the Australian laws that apply to asylum seekers, he was unwilling to lodge the application.
Fortunately, with advice and assistance from the Refugee and Immigration Legal Service, he was able to submit his protection application before the deadline. This gave him the opportunity to have his claim assessed.
