North Queensland Women's Legal Service assisted Penny to have her 11 month old baby, Sally, returned to her care after the baby’s father had taken her to Mt Isa.
At the time, Penny was distraught and did not know what to do. She had contacted the Police but was told they were unable to do anything. Penny and her children had been relocated away from Mt Isa by DV Connect and the Police after a very serious incident of domestic violence where Larry threatened Penny and her mother with a knife. During the same incident Sally was injured when Larry pushed Penny over whilst she was carrying her.
North Queensland Women's Legal Service immediately contacted the Police and requested a welfare check on Sally.
Court documents were prepared to allow Penny to file an urgent recovery order in the Federal Circuit Court in Cairns to have Sally returned to her care. The order was granted and Sally was returned to her care on Friday morning.
Once Sally was safely back in Penny’s care, North Queensland Women's Legal Service then assisted Penny to report the breaches of the Domestic Violence Order to the Police.
