Bob* contacted the Cairns Community Legal Centre in relation to a dispute with an insurance company arising from a motor vehicle accident. The accident was caused when the other driver made a right-hand turn in front of the client’s oncoming vehicle and Bob’s vehicle was written off. Bob speaks English as a second language and was having difficulty negotiating with the other driver’s insurance company.
The Centre sent letters of demand and negotiated with the other driver’s insurance company on behalf of Bob, including preparing and providing various documents as requested by the insurance company. The insurance company eventually ceased negotiations and failed to reply to further correspondence.
The Centre drafted and prepared a Complaint to the Credit and Investments Ombudsman on behalf of Bob. The insurance company ultimately agreed to recommence negotiations with the Centre.
The Centre successfully negotiated a settlement of the full amount sought in the initial letters of demand. Within days of reaching the settlement agreement, the insurance company deposited the full settlement amount into Bob’s bank account.
Bob was extremely grateful for the assistance which the Centre provided and for the outcome achieved.
